Hello Everyone, This is Anadi Nayak, a student of B.A., LL. B. (Hons.) and a member of LITIGIUM, The DebSoc of SOL-JLU, here to put my opinions on punishment and its role & necessity

I would like to start by quoting debatebly, the best book to ever exist.

Shreemad Bhagvad Gita,
Chapter 10: verse 38

दण्डो दमयतामस्मि नीतिरस्मि जिगीषताम् |
मौनं चैवास्मि गुह्यानां ज्ञानं ज्ञानवतामहम् ||

I am just punishment amongst means of preventing lawlessness, and proper conduct amongst those who seek victory. Amongst secrets I am silence, and in the wise I am their wisdom.

The ambit of punishment as a means of discipline does not limit to schools and institutions, it is a part and parcel of life, as no problem comes without a solution, similarly, no wrong comes without a punishment. Now when I say a Wrong in this particular scenario, it means an act which has been done knowing or understanding the consequence of it, because if some act is done without knowing or understanding the consequence of it, becomes a mistake.

And on the level of practicality, mistakes are not to be punished, because if you punish someone for an error they make, you are taking away their scope of improvement and betterment, because now, they would work in order to save themselves just from making that mistake or creating that error and saving themselves from the punishment, which automatically reduces and removes the chances of innovation.

The concept of punishment was created to spread awareness about the consequences of committing any act which is against law, and to give law a stick when the carrot doesn't work.

But punishments have been incurred as a means of threat to make people disciplined, now what nobody understands here is the fact that, when you give them a punishment it is not making them disciplined, instead it is making them a silent puppet of that stick of punishment.

Great points. But, the system of rewards and punishment has been created by society to incentivise good deeds and disincentivise unpleasant deeds which can cause harm and pain to others. 

What could be a replacement to this?

Saying that punishment should not be practiced is easy in theory. In practice, how would you then teach those being socialised as to what is unacceptable?

For a child who creates a ruckus in the classroom, a hard slap won't be the right punishment, but asking him to regulate the class for even a single session will do the work, as the message would then spread, peacefully and through their own experience.

I am not against punishment, I am against the physical punishments, which make no sense, the best type of punishment is the one, which brings in reformation of the child, not the one which causes trauma to them.
